TERMS OF SERVICE
By sending your first payment to us, you agree to these terms of service. Not reading this TOS does not exempt you from them.
DISCLAIMER
We are a team of two disabled individuals with autoimmune disease, nerve damage, vision problems and other conditions that inhibit our day-to-day abilities. Please be aware that we work at a different pace to accommodate our disabilities. This also means we will have our assistance animals with us at all times. Please take note of this for allergy reasons.
Payment
A 20% NON REFUNDABLE down payment is required upon acceptance. Work will not begin until the suit is paid off.
I accept Paypal and Square. The prices we have listed are all in USD.
Quotes are subject to change. Please keep in mind quotes can widely vary due to to the style or color of fur used, amount of colors, materials, how much detail is involved (small markings, etc) and features of the character like horns or wings. I only give quotes when I am opening for commissions, the quote you are given is what you will pay if you are selected for that opening. Quotes after that point are no longer valid and you will have to get re-quoted at the next opening.
Payment Plans
Payments must be made at least once a month after the down payment has been paid.
Late payments result in later completion. If you fail to make payments, your spot in our queue will be moved down.
Failure to make a payment within 15 days of the monthly due date will result in a $25 fee. These will accumulate each 15 days thereafter until a payment is made. If a payment is going to be late, please contact me ahead of time so I can understand the nature of the delay.
If payments cease and contact cannot be established, your commission will be terminated; all progress and materials will be considered forfeit. This will lead to you being permanently blacklisted under all accounts. No refunds will be given to those who fail to make payments.
Monthly plans should not exceed 8 months.
Reference Sheets
Please send a clear, up-to-date reference sheet. We prefer 2 or 3 view references. A clear, up-to-date digital reference sheet is REQUIRED in order to commission a fursuit. I am not responsible for including anything that is not present on the agreed concept art. If you are having us design your suit, we will work with you on creating a design.
Reference sheets are followed very closely. Please let us know if there are any elements or details on your reference which you do not want to include/want us to change, otherwise we will follow your reference and no changes can be made for details not discussed in writing previously once work has begun.
DTD (Duct Tape Dummy)
-We do not work off of measurements only, we require you to send a DTD. Please make sure you spend time making your DTD correctly as this is a crucial part of the suit making process and affects how the suit will fit you.
Your DTD is REQUIRED to include your feet. Your DTD is REQUIRED to be made out of Duck brand colored duct tape.
Any color or combination of colors will work. We WILL NOT accept any silver tape DTDs. We are not responsible for poorly fitting suits due to poor DTD construction. We are not responsible for a DTD coming apart due to poor construction. If your DTD falls apart when We are stuffing it, you will be required to make a new one. Remember, a good DTD is the key to a good bodysuit.
When you send your DTD please include somewhere within the package who it belongs to.
Please keep in mind our suits are more on the form fitting side. Do not make your DTD too tight.
Commission Process
I do send work in progress photos! I love to share what I am doing with my clients. You will be involved for the entirety of the process. Once work begins on your suit, we will let you know and update you often as we go along. We will work with you directly to select the best possible options for fur colors and materials. Please keep in mind not every color exists in fur, so we will do our best to match your characters colors. We are happy to send you swatches of the material and color options for your suit before work begins.
Turn around time on a suit, once started, is around 2-3 months. The time it takes to get to you in the queue will vary.
Changes and Cancellations
Please make sure you are financially secure before commissioning us. Your deposit is NON-REFUNDABLE. If you decide to cancel and we have begun work on your suit or completed any part of it, it will affect how much you can be refunded.
-A 20% nonrefundable down payment is required. If you drop out or your commission is terminated, you have no rights to this 20% or materials purchased.
0% complete - 80% refund
25% complete - 50% refund
50% complete - 20% refund
75% complete - no refund
100% complete - no refund
We have up to 6 months of the date of your requested refund to refund you in full.
We reserve the right to deny changes to the character design once the suit making process has begun. If we do not deny the changes, there will be a fee for the extra labor, depending on how complex the change is and if we need to purchase extra supplies.
We reserve the right to terminate your commission at any time.
We have the right to deny a commission for any reason. We have the right to not disclose our reason.
Deadlines/Completion
We do not work with or promise any hard deadlines or completion dates under any circumstances whatsoever. Please be understanding of this. You are free to request a soft deadline, but please keep in mind you will have to have been fully paid off and have sent in a DTD at LEAST 3 months prior to your requested deadline and have notified us at least 3 months in advance. Please keep in mind this is only a two person operation, we do not promise deadlines since many things can come up. Sickness, medical emergency, or machines breaking.
We work in order of who has completed their full payment first and who has sent us a DTD. Failure to make a full payment will push your commission back. Failure to send a DTD in a reasonable amount of time will push your commission back.
Warranty
There is a 1 year warranty on costumes. After 1 year, the buyer will pay for repairs. The buyer must pay shipping costs.
Please keep in mind you are receiving a handmade one of a kind item. There may be imperfections.
If you find any issues upon receiving your suit we are happy to fix them. Do not be afraid to email us about anything you are unhappy about. You may also find us at any con we are attending and we will be happy to help you fix any loose seams etc.
Fixes to your suit are free for the first year. However, this only applies to issues with your suit. If we determine that the issue is cosmetic and not an issue with structure, we will require you to pay for the changes. We are the only ones that will determine what is an issue and what is cosmetic based on the photos/explanation given and ultimately decided once we receive your suit back in the mail and go over it. For example, issues include: loose stitches/broken stitches, holes, any part of the suit coming loose/off, paint chipping, etc. Issues that are cosmetic and will require payment include: Changing out any part of the suit for preference only, ex wanting the nose changed because you do not like the fact that is has nostrils, wanting ears changed because you do not like that they are soft foam, wanting eyes changed to a different style because you do not like them, etc.
Please be sure to go over with me any questions about how I make my suits and the style I make them in/Materials I use so you can avoid not liking the way something is done.
It is recommended that each customer learns basic hand sewing to do simple repairs that happen over time, like any other article of clothing, fursuits eventually experience natural aging, wear, and tear.
If I determine you have caused intentional damage to your suit, I have the right to deny repairs. Any unauthorized alteration or changes not made by myself voids the warranty.
Shipping
Shipping is NOT included in the cost of your commission. Shipping is calculated once the commission is completed. All packages come with Insurance. Overseas commissioners will have to pay for shipping. We are not responsible for customs/import fees. We will only use USPS or UPS. We are not responsible for damages that may occur or any losses during shipping.
Age
You must be 18 years or older to commission us. We have the right to ask for photo ID.
If you lie about your age, or we suspect you are lying about it, refuse to provide an ID when asked, or use a false ID, your commission will be terminated, you will not be refunded, and materials will be forfeited.
Anything agreed upon by both parties in writing, including email, is a binding contract. By submitting a commission form or sending your first payment, you agree to all of the terms of service.
By Agreeing, I [the commissioner] have read and understand this Terms of Service. By agreeing to this contract I am stating I understand and consent to a No-Deadline Timetable. I am also confirming that I am over the age of 18, and am fully capable of making payments. I agree to the payment plan set in place at the time my quote was given.
We are not responsible for injuries sustained while using our products.
All handmade components and patterns of our suits are property of ItsProbablyMars. You may not replicate any part or piece of our work.
